By registering with Freshtxt, Inc. (“Freshtxt”) you confirm that you have read, understand and agree to the provisions of this Privacy Policy and to our Terms of Service. Freshtxt knows that you care about how your personal information is used and shared and we take your privacy very seriously. This privacy policy explains how we collect, use, share and protect information obtained from users of Freshtxt http://www.Freshtxt.com.

1. What is Freshtxt's product and why is my information needed?

Freshtxt is an online service that allows users to easily send notification messages directly to their customers mobile phone. Because Freshtxt is Web based, it requires the use of first and last names, billing contact information, a password and a valid email address as a login. Therefore, at a minimum, we require such necessary information during the registration process.

2. What information does Freshtxt gather/track and how is it used?

PERSONAL INFORMATION: Because of the nature of our product, we must collect personal information from users during the registration process, including (at minimum) first and last names, an email address to be used as a login, billing contact information, credit card number and a password. When a user registers online for a free trial of the service, Freshtxt will take steps to validate the credit card and billing information supplied to us to ensure it is accurate. We also use this information to determine your eligibility for our one-time free trial offer. The credit card information supplied will then be used to establish your subscription with us should you decide to continue the service after the free trial has ended. Your email address may be used to send you periodic newsletters from Freshtxt and Freshtxt. We may also send you offers on behalf of our third-party partners. Users can opt out of promotional emails at anytime, but will still receive communications such as receipts, confirmation emails and customer service updates that are considered necessary to provide the service to you. We use the information collected to deliver services, process payments, update our records, communicate with you about products and services and generally maintain your accounts with us. We do not share, sell, trade, or rent your personal information to third parties for unknown reasons.

BUSINESS INFORMATION: We will not view Business Information except as necessary to appropriately support the service. We will only use the Business Information provided for the purpose of anticipating, diagnosing, supporting or resolving any problems that might limit or disrupt the quality of your Freshtxt experience.

MESSAGING INFORMATION: Any personally identifiable information such as names and mobile numbers a business submits while in-session in order to send messages to their customers is considered confidential. Freshtxt may store that information, but we will not use the information to send any additional communications.

SESSION RECORDS: To maintain our quality of service and to assist in the analysis of product performance, we may gather data on connection information and message transmissions during a session. The gathered information is used only to ensure Freshtxt provides the highest quality experience possible.

SECURITY INFORMATION: Freshtxt may collect certain standard information about your computer for security and identification purposes. This information may include: IP addresses, domain names, access times, cookies, and other uniquely identifying information of machines using the Freshtxt software. This information is used for the operation of the service, to identify and protect our customers and to control unauthorized use or abuse of our services. All information is stored securely within our servers.

TRAFFIC PATTERNS: We may track aggregate traffic patterns throughout our site. However, we do not correlate this information with personally identifiable data about individual users. Such information will not be passed to third parties without your prior consent unless where required by applicable law.

3. With whom does Freshtxt share the information?

Freshtxt products and services by necessity require us to provide some of your information to third parties. We may occasionally employ other companies to perform functions on our behalf. Examples include processing credit card payments, sending postal mail and email, analyzing data and providing marketing assistance. They have access to personal information needed only to perform their functions and may not use it for any other purpose. Further, they must process the personal information in accordance with this Privacy Policy. Also, in the event that Freshtxt or substantially all of its assets are acquired, customer information will be one of the transferred assets.

4. How can I review, correct and update my personal information?

If you wish to change your personal information, go to your My Account page where you can change your user name, email address and password, as well as update your credit card and billing information.

5. How does Freshtxt protect my information from loss, misuse or alteration?

Freshtxt uses industry-standard efforts to safeguard the confidentiality of personally identifiable information, including encryption, firewalls and SSL (Secure Sockets Layer).

Furthermore, Freshtxt is not liable for loss of passwords due to user carelessness. If you lose control over your password, you may lose control over your personally identifiable information. If you believe your password has been compromised, we recommend that you immediately change your password. For information on how to do this, please see item number 4 above.

6. How can I stay informed of any changes to the privacy policy?

Freshtxt reserves the right to change this privacy policy from time to time at its discretion. Changes will be posted on the privacy policy web page and will be effective upon posting. Your continued use of Freshtxt after changes to this online privacy policy have been posted is deemed acceptance of those changes. It is your sole responsibility to monitor the privacy policy to determine whether any such changes have been posted.
